These Terms of Service (“Terms”) govern your access to and use of the TruePulse platform (“Service”) operated by TruePulse (“we,” “us,” or “our”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
TruePulse is a cloud-based employee survey platform that allows organisations to create, distribute, and analyse anonymous employee surveys. We provide tools for pulse surveys, engagement surveys, wellbeing checks, and onboarding surveys, along with analytics dashboards and reporting.
You must be at least 18 years old and authorised to act on behalf of your organisation to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@true-pulse.online if you suspect unauthorised access.
Each account is associated with a single organisation (“Tenant”). You may invite other administrators within your organisation to access your Tenant account. You are responsible for ensuring all administrators comply with these Terms.
You agree not to use the Service to:
TruePulse offers a free plan and paid subscription plans billed monthly or annually. Paid plans are charged per employee per month based on the number of employees in your directory at billing time. Pricing is shown on our pricing pageand may change with 30 days’ notice.
Payments are processed securely through our payment processor (Stripe). We do not store your full payment card details. By providing payment information you authorise us to charge your payment method on each billing date.
If a payment fails, we will notify you and attempt to collect payment again. If payment cannot be collected within 14 days, your account may be downgraded to the free plan or suspended.
The free plan is available indefinitely subject to the usage limits described on our pricing page. We reserve the right to modify free plan limits at any time with 30 days’ notice to existing free plan users.
You retain ownership of all data you upload to the Service, including employee lists and survey responses (“Customer Data”). We do not claim any ownership of Customer Data.
You grant us a limited licence to process Customer Data solely for the purpose of providing the Service to you. We will not use Customer Data for our own commercial purposes, sell it, or share it with third parties except as necessary to provide the Service or as required by law.
Where we describe survey responses as “anonymous,” this means that our platform does not link individual survey responses to employee identities. Aggregate results are only displayed when a group contains a minimum number of respondents (as specified in your account settings, typically five or more). You agree not to attempt to circumvent these anonymity protections.
The Service, including its software, design, and content (excluding Customer Data), is owned by TruePulse and protected by intellectual property laws. Nothing in these Terms grants you any rights in the Service beyond the limited licence to use it as described here.
Each party agrees to keep the other’s confidential information private and not to disclose it to third parties without the other’s consent, except as required by law.
The Service is provided “as is” and “as available.” We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by law, TruePulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
You agree to indemnify and hold harmless TruePulse from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Either party may terminate these Terms at any time. You may close your account by contacting us at support@true-pulse.online. We may suspend or terminate your account if you breach these Terms, with or without notice depending on the severity of the breach.
Upon termination, your access to the Service will cease. We will retain your data for 30 days after termination, after which it will be deleted. You may request an export of your data before deletion.
We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
